Why Wait To Instruct Your Property Solicitor When Moving House

It Makes Sense To Instruct A property Solicitor Promptly

If you are moving house, selling your home, buying a property or remortgaging your buy to let then it makes sense to instruct a lender approved property Solicitor promptly.

So many Sellers and Buyers of UK property are slow to instruct a Solicitor. This means that when the time comes and an offer has been accepted they are someway off on getting their conveyance moving forward. This creates doubt and increases stress levels.

Each Party Must Pass Over Their Solicitor Details At Offer Acceptance Stage

Initially you make conveyancing choices and choose which approved lender Conveyancer to Instruct. On instruction via the Homebuyer Conveyancing Comparison website the chosen Solicitor calls the Client at a predetermined convenient time and discusses the quote. If the Client is happy to proceed the Solicitor sends out by email a Client Care pack. The Client reads the information and must return promptly the signed terms of engagement. On receipt the Solicitor will start the conveyance and carry out ID checks.
This for the majority of people who are proactive can take just a few days.

Delaying The Return Of Property Particulars Has Obvious Consequences

If you delay the return of property particulars your Solicitor may chase you once. If they don't then it's simply because they feel you are not committed to getting to exchange as fast as is possible. If they have quoted for the work then with their experience they know that they can manage your case effectively from start to finish. If it is a slow start then already they are concerned that your case will take longer than it should. If you are prompt at the start and plan ahead your move then your Solicitor can get moving instantly at the offer acceptance stage.

All Parties Enjoy A Property Deal When It Is Completed In Under 8 Weeks

You will read news articles that Completions are taking longer and that Buyers may miss the Stamp Duty Land Tax deadline.

Unfortunately the reasons for delays are often caused by poor planning :-

1) Buyers and Sellers should have a Solicitor instructed and the ID checks completed before offer acceptance stage.

2) The Buyer must be proactive and instruct the right Survey promptly. This will involve intense searching as many Surveyors are booked up for several weeks. The Survey needs to happen within 1 week of the offer.

3) Property Information Form must be completed at the outset and not when the Buyer Solicitor requests it

4) Before making an Offer The Buyer should know which Mortgage Lender is going to provide the finance. They should also instruct a Solicitor that has been approved by that lender

5) The Seller should get their property upto the RICS standard before they put their house on the market for sale. Why wait for a poor survey result.

6) Each party from the outset must be keen to agree when a realistic exchange date can be met.

The key of course to a successful move is to plan ahead and get your ducks in a row.
